If you look at the historical imagery in Google Earth, there is actually some newer imagery (maybe even from this year) than the default imagery that is rather poor quality, but it appears the washout has been repaired recently (if we're talking about the same washout).
Nobody should be allowed to develop their private property as they see fit. It should always be put up to a public vote, and private landowners should just eff off.
My first thought was Zedd's Meadows as well but I couldn't line up the background scenery in Google Earth. UM Creek was throwing me off because while the scenery lined up, the trees on the hillsides look so much more dense in the photo than in the sat imagery.
